These Terms and Conditions govern the use of the TempX platform, including the TempX Business App and TempX Worker App. By accessing or using TempX, all users agree to comply with these Terms.
1. About TempX
TempX is a technology platform that connects businesses requiring temporary workers with individuals seeking temporary jobs.
Examples include hotels, restaurants, shops, warehouses, event organizers, delivery businesses, and other employers posting temporary work opportunities. Workers can search for jobs within a selected radius, apply for jobs, complete assigned work, and receive payments through the TempX platform.
TempX acts only as a marketplace platform and is not an employer, staffing agency, or contractor.
2. Eligibility
Users must be at least 18 years old to use TempX. All users must provide accurate and updated registration information. TempX reserves the right to suspend accounts containing false or misleading information.
3. Business Responsibilities
Businesses agree that all job postings must be genuine, lawful, and accurate. Businesses are responsible for workplace safety, legal compliance, salary commitments, and respectful treatment of workers.
Businesses must not post:
• Illegal jobs
• Unsafe work
• Misleading salary details
• Discriminatory job listings
• Adult or prohibited services
4. Worker Responsibilities
Workers agree to:
• Attend assigned jobs on time
• Complete work professionally
• Avoid misconduct or abusive behavior
• Maintain accurate attendance records
• Avoid fraudulent activity
Workers are solely responsible for their conduct during assignments.
5. Platform Fees
TempX charges platform/service fees from both Businesses and Workers.
• Businesses may be charged posting fees, hiring fees, transaction fees, or convenience fees.
• Workers may be charged platform fees or transaction deductions from payouts.
Applicable fees may change at any time and will be displayed within the platform.
6. Job Application and Assignment
Workers may search and apply for jobs within their selected geographic radius.
Businesses may accept or reject applicants at their discretion. Once a worker accepts and confirms a job assignment, both parties are expected to fulfill their responsibilities.
7. Payments and Weekly Settlement
Payments for completed jobs will be processed through TempX.
• Businesses authorize TempX to collect payments on their behalf.
• Worker payouts are generally settled every Monday.
• If Monday is a bank holiday or public holiday, payments may be delayed.
• TempX may deduct platform fees, taxes, penalties, or applicable charges before payout.
TempX may temporarily hold payouts in case of disputes, fraud investigations, or attendance verification issues.
8. Attendance and Verification
TempX may use GPS tracking, OTP verification, QR check-ins, attendance logs, or manual confirmations to verify job completion.
Fake attendance, proxy attendance, or fraudulent check-ins may result in:
• Account suspension
• Payment cancellation
• Permanent ban from the platform
9. Cancellations and No-Shows
Businesses and Workers should avoid unnecessary cancellations after confirming jobs.
Repeated cancellations, no-shows, or job abandonment may result in:
• Reduced account visibility
• Temporary suspension
• Permanent account termination
10. Independent Contractor Relationship
Workers registered on TempX are independent service providers and not employees of TempX.
Nothing in these Terms creates:
• Employer-employee relationship
• Partnership
• Agency
• Joint venture
between TempX and any user.
11. Non-Circumvention
Businesses and Workers agree not to bypass TempX to avoid platform fees after connecting through the platform.
Users attempting direct off-platform hiring or payment arrangements may face:
• Account suspension
• Penalties
• Permanent restrictions
12. Ratings and Reviews
Businesses and Workers may rate and review each other after job completion.
TempX reserves the right to remove fake, abusive, defamatory, or misleading reviews.
13. Fraud Prevention
TempX strictly prohibits:
• Fake job postings
• Fake worker profiles
• Duplicate accounts
• Identity misuse
• Payment fraud
• Manipulation of ratings or attendance
TempX reserves the right to freeze payouts, suspend accounts, or report fraud to legal authorities.
14. Worker Safety
Businesses must provide a safe and lawful work environment.
Workers may report unsafe conditions, harassment, abuse, or illegal activities directly to TempX support.
15. Privacy and Data Usage
TempX may collect and process:
• Location data
• Attendance records
• Device information
• Payment details
• Usage analytics
for operational, security, fraud prevention, and service improvement purposes.
16. Communication Consent
By using TempX, users agree to receive:
• SMS
• WhatsApp messages
• Push notifications
• Emails
• Calls
related to jobs, payments, promotions, verification, and platform updates.
17. Suspension and Termination
TempX may suspend or permanently terminate accounts for:
• Fraudulent activity
• Misconduct
• Abuse
• Non-payment
• Violation of these Terms
• Illegal activity
18. Limitation of Liability
TempX is only a technology platform connecting Businesses and Workers.
TempX shall not be liable for:
• Workplace disputes
• Worker misconduct
• Business payment disputes
• Injuries
• Delays
• Indirect losses
• Service interruptions
Users engage with each other at their own risk.
19. Force Majeure
TempX shall not be held responsible for delays or failures caused by:
• Natural disasters
• Internet outages
• Banking failures
• Government restrictions
• Technical issues
• Events beyond reasonable control
20. Governing Law
These Terms shall be governed by the laws of India. Any disputes arising out of the use of TempX shall be subject to the jurisdiction of the courts in [Your City/State].
